Faced with using “a slow and buggy device that disrupts everyday life”, the action alleges that an unspecified number of iPhone 4s users spent “hundreds of dollars” upgrading to a newer iPhone model. The lawsuit said affected users believed they should have been warned that “iOS9 may or will degrade overall performance and usability” prior to install, as iOS users could not roll back to the previous version of the operating system. Apple Insider reported that the plaintiffs seek “over $5 million in damages with an option to treble” and that no hearing dates have been set.
